Profits a Prendre … bite size

Profits a prendre are rights which one person has to take something from someone else’s land. This could be minerals, crops or wild animals.

There are two types of profit:

  • A several profit which is a right which is owned exclusively by one person.
  • A profit in common which is a right which is owned by one person in common with others.

Unlike easements, profits can exist ‘in gross’. This means that it is not necessary for the person who has the benefit of the profit to own adjoining or neighbouring land.
