The Access to Neighbouring Land Act 1992 … bite size

The Access to Neighbouring Land Act 1992 gives property owners the rights to go onto neighbouring land to carry out necessary repair works to their property.

An access order can be made by the county court. The order is not a legal easement and it will specify the extent of access and any compensation payable.

For the access order to bind future owners of the servient land, it must be registered.

Access orders are allowed for maintenance, but not for development of the land.
